The Donall Estates Property Owners Association welcomes and encourages the use of our parks for the enjoyment of all of its residents, therefore, all USERS (Owners, their children, occasional invited guests and tenants ) are required to adhere to the following rules and regulations.
The Board of Directors of Donall Estates Subdivision with the assistance of the Properties, Accounting and Legal Committee may change these rules and regulation at any time, with any changes to be effective upon circulation thereof to the Members of Donall Estates Property Owners Association, Inc.
Upon any violation of the rules and regulations, the Properties, Accounting and Legal Committee of the Board of Directors of Donall Estates Property Owners Association, Inc. may suspend all access rights to Fisherman's Park for the remainder of the calendar year, or such a lesser period as determined by the Committee, or may assess a fine of not more than $200.00 for each violation which shall accrue to the General Fund of such Association.
Fisherman’s Park is for the sole use of Property Owners, i.e., record owners of lots within Donall Estates Subdivision (“Owners”) and their children, occasional invited guests and tenants who are residents within Donall Estates Subdivision (collectively “Users”). All use of Fisherman’s Park is at the sole risk of the User.
To the extent any Owner permits any family member, tenant or guest to use Fisherman’s Park, that authorizing Owner is responsible for the conduct of and all damage claims asserted by such family member, tenant, guest or their successors or assigns.
Owners and/or their guests must have an Access Card/or Clicker in their possession within the park and be willing to show the same upon request.
The gate to Fisherman’s Park shall be kept closed at all times except during actual ingress and egress. The Access Card to the gate at Fisherman’s Park shall not be sold, loaned, assigned (except to an occasional guest), or given away by any Owner. Each Household (“Lot(s) that are used collectively and are substantially owned in common shall be treated as a single household”) that is current on all assessments and whose privileges to Fisherman’s Park have not been revoked, shall be entitled up to two (2) clickers at the cost of $50.00 each. Replacement for lost cards or clickers will be issued upon receipt of a statement that a card or clicker has been lost or destroyed, accompanied by the card number and payment in the sum of $50.00. Lost card numbers will be deactivated. Please note since Access Cards are no longer available, an Access Clicker will be issued.
No Owner shall be permitted to have more than two vehicles in the Park at any time. As used above, one vehicle can include the tow vehicle, a boat and boat trailer as a part of the same vehicle.
Vehicles may be parked only at locations where they do not interfere with the continued use of the gate, boat ramp and the Fish House, and should be parked in such a manner as to permit other Users to fully utilize Fisherman’s Park. Vehicles shall be parked within Fisherman’s Park only when the Park is actually being used, and the Park is not to be used as a parking lot except while the accompanying boat is on the lake. No parking shall occur in front of the gate or on the private property of any of the properties adjoining Fisherman’s Park without the permission of the owner of such property.
Launching and trailering boats shall be in the most expeditious way possible while still maintaining safe operations. Boats should be made ready to launch before backing down the ramps so as to minimize the time for launching and trailering boats.
Please ask for or offer a hand if there are difficulties in launching or retrieving a boat.
The park pavilion shall be available for the non-exclusive use of parties over 15 people on non-holiday weekends. The pavilion is available at no charge to members in good standing and with prior written approval from the DEPOA Board. Please allow at least two (2) weeks prior notice for any reservation request. In case of multiple requests for same date, requests will be considered in the order they are received through info@depoa.org /website. Upon approval the reservation will be posted at www.depoa.org/fishermans-park%2Fevents.
All Users shall observe the “No Wake” zone around Fisherman’s Park, and are encouraged to observe the “No Wake” zone at all locations within Lake Buchanan.
No boat may be moored on the Fish House except at the dock portion, and no boat may remain moored for more than 15 minutes.
The following are prohibited in Fisherman’s Park:
a) Excessive use of alcohol;
b) Fireworks (except on July 4th, Memorial Day and New Year’s Eve when no burn ban is in effect);
c) Discharge of Firearms;
d) Dogs not under control;
e) Profane language; and
f) Swimming at or on the boat ramp or in such proximity thereof as to be unsafe for boats and trailers using the ramps.
All children under 10 years of age must be accompanied by an adult.
DONALL ESTATES FISH HOUSE RULES
Fish shall be cleaned only at the fish cleaning table, and the fish cleaning table shall be left clean and tidy following the cleaning of fish.
All users of the Fish House shall remove out of Fisherman’s Park all trash and litter, including cigarette butts.
Users shall be courteous to other users and potential users of Fisherman's Park and the Fish House, including restricting the number of rods by each user so that everyone desiring to fish at the Fish House has space to do
All children under the age of 6 and all persons who are not competent swimmers shall wear a life jacket while at the Fish House and on the ramp leading to the Fish House.
Diving and Swimming are prohibited on or in the immediate vicinity of the Fish House and dock.
Please turn off all lights if you are the last to leave at night.
DONALL ESTATES PRIVATE DOCK MAINTENANCE POLICY
Any project requiring use of the park for dock maintenance or construction MUST have prior written consent from the DEPOA Board.
There is a five calendar day maximum on all projects. If a project runs over five days the owner of the project must have written consent for the extension.
Each project must have a Donall Estates resident who is responsible for the project.
For each project, there shall be a notice posted on the DEPOA.org website and at the Fisherman's Park board providing identity and all contact information for the responsible Donall Estates resident in case a property owner in Donall Estates has a safety or other concerns with the use of the park for such purposes.
Each site must be kept clean and safe and every effort must be made to minimize any disruption to the use of the boat ramp, pavilion, restroom and trailer parking.
The board encourages the use of the park for this purpose to be between September 15th and February 15th in order to minimize disruption to the use of the park by swimmers, boaters, fishermen, etc.
